Then the question becomes, would the consumer have a "subrogation" type claim against the seller. And the answer is probably not, which might change up the application of the collateral source rule.

  4. He probably got his brain trust together and decided they would rename them “Anti-tariffs”. Problem solved.
  5. When we were dealing with the very real differences between our girl and boy and how they learned and interacted with the world, this book was a fantastic and enlightening resource: And NONE of this needs to be about "woe is me, we're fucking over boys," or anything of that sort. As the landscape changes -- and the seismic shift of the past 50+ years, giving women never-before-had nearly equal access to education and career opportunities IS a landscape change -- how we equip people for that landscape should change. Before, there was an inherent bias in favor of boys because there was a literal bias (women weren't allowed to do many things). Now, there's some systemic bias that favors women at certain stages simply because gender comes with qualities and approaches that fit certain systems better (or worse). And if you want to layer race into it, it makes the dilemma for WHITE men even more demoralizing. And again, NOT saying "it's not fair," it's just math. If, as a white man, my only competition for a Senior VP of Marketing at Acme Enterprises was...just other white men, and TODAY, my competition is men of ALL races, AND women, well....math says that my odds of getting that sweet gig at Acme are lower. The REACTION of men to that change is important. Pouting and saying "t'aint fair, women are bitches, and I'm just gonna play video games" is a weak-ass play. But it's ALSO a weak-ass play to tell them "you had the advantage forever, and previous generations of (white) men fucked over previous generations of minorities and women, so now it's YOUR turn to get fucked." There are social, educational, and legal issues in play here. Nobody has the perfect recipe. I don't get the hate for Scott Galloway (other than he's a pithy marketer, as opposed to a seasoned strategist), as I think his big-picture observations as to what has happened and what we should consider sure seem to have merit to me. He doesn't indulge in the Jordan Peterson self-indulgent "it's not your fault, you should be pissed, and be a dick" recipe.

Gorsuch, Barrett and Kav have a bit of the wildcard in them. Barrett seemingly especially. less so Gorsuch and probably even less so Kav. Because the majority opinion basically even handedly applies the major questions doctrine and jacks it up Trump's ass, I imagine Clarence and Sammy create some kind of GOP/Wilhoit loophole in the major questions doctrine.

Of course, Alito and Thomas dissent. Kavanaugh does too which is only slightly less surprising. Gorsuch joining the majority (at least as to result) is somewhat heartening.

Probably like the collateral source rule. You paid an unlawful tariff/were tortiously injured. That you had another source of compensation in the form of markups/insurance is irrelevant to the fact of the injury and the amount.
