The lunacy of America’s gun laws
I have been saying this ever since Sandy Hook. I think it's inevitable at this point. The Republican strategy should be to minimize the effects, yet they aren't doing that at all.

San Marcos to hire armed civilians for elementary schools
I'm not sure how many school shooters think they're going to get away with it.

San Marcos to hire armed civilians for elementary schools
This will never work. They will figure out who the "marshalls" are quickly and just go shoot up a classroom with no marshalls. We need walls around our schools and at least three fully armed soldiers in every classroom. It's the only way to be sure.

Things Not Going Well for Alec Baldwin
Not to split hairs, but if it gets to the point that it's reckless or criminal negligence, then it's no longer an accident.

Black Teenager Shot for Ringing Wrong Doorbell
Even if it's illegal, I'm pretty sure our honorable governor would give me a pardon.

Black Teenager Shot for Ringing Wrong Doorbell
HOLY SHIT I live in a nice neighborhood and just now there is a Hispanic male in his 50's who appears to be looking for something in my front yard. Should I fucking blow him away with my shotgun?

How Fox News works
Yes and off the top of my head I would think that, had the jury made a factual finding that Fox had acted with malice, the U.S. Supreme Court would not be able to review the sufficiency of that determination. It's a moot point now with the settlement, but it would have been something Fox should have considered before going to trial.

How Fox News works
Happy to help. U.S. Supreme Court reviews of State Supreme Court decisions are rare but they happen.

For the life of me, I can't understand why you think any of this is relevant.

How Fox News works
Thank you for letting me know I am free to research it. I am not sure how Fox could have a First Amendment claim based on the verdict until there’s actually been a verdict, but if so I’m pretty sure they can appeal that to the U.S. Supreme Court like NYT v. Sullivan. I don’t know if the U.S. Supreme Court would have any basis or jurisdiction to overturn a finding of malice though. Half of us are lawyers here so I was hoping someone knowledgeable would respond.

How Fox News works
I did not take federal courts but I did take Prof. Rabban's First Amendment class at UT. How did the U.S. Supreme Court have jurisdiction to reverse the Alabama state trial court's verdict based on the First Amendment in NYT v. Sullivan?
-
How Fox News works
Wouldn’t the First Amendment defense be one of a few possible federal questions that the Supreme Court could rule on after the state appeals have been exhausted?

Desantis is a POS and needs his own thread
Disney needs to make a cartoon of Mickey Mouse outsmarting some Troll that looks exactly like DeSantis.
-
How Fox News works
Excuse me if this is a stupid question but I have zero federal appellate experience. If a jury makes a finding of actual malice, and this case gets appealed to the U.S. Supreme Court on a federal question, is there any way for the U.S. Supreme Court to disturb that jury finding? Also, could Fox have removed this case to federal court? If so, then why didn't they?
-
Desantis is a POS and needs his own thread
What's surprising to me is how easily DeSantis appears to have been out-lawyered. Doesn't this make him objectively look like he doesn't know what he's doing?

Woman shot and killed after car she was in pulled into the wrong driveway
Some people like using guns and they look for reasons to use them. Also, I don't know about New York, but in my experience an awful lot of Texans think that you can legally kill someone who is "trespassing" on your land.
