LEANDER, Texas — Six years after Greg Kelley, a then 18-year-old Leander resident, was accused of sexually assaulting a boy, the state's highest criminal court has overturned his conviction, marking the end of a long and controversial case.

His case will be sent back to Williamson County, according to court documents obtained by KVUE Nov. 6. District Attorney Shawn Dick has indicated that he has no plans to go forward with the case, meaning Kelley can move forward with his life.

The Leander resident was accused in 2013 of sexually assaulting two 4-year-old boys at an in-home daycare operated by a friend's family.

Kelley's case has grabbed public attention since it started six years ago. At the time, he was 18 years old and was a football star at Leander High School. His arrest sparked outrage from those who knew him and immediately proclaimed his innocence.

Kelley went to trial in 2014 and was found guilty of two counts of super aggravated sexual assault of a child. He accepted a sentencing deal in which he would spend a mandatory 25 years in prison.

Kelley, now 24, has always maintained his innocence.

He has been out of prison since August 2017, when District Judge Donna King released him on bond amid new questions about his guilt. He has maintained a relationship with his girlfriend, proposed soon after his release and is set to marry early next year.

District Attorney Shawn Dick agreed soon after taking office to review the case after Kelley's new attorneys brought what prosecutors deemed credible evidence that someone else may have assaulted a 4-year-old boy in a home where Kelley was staying.

During a hearing in August 2017, Kelley's attorneys argued that he was the victim of a deficient investigation by the Cedar Park Police Department and that his attorney had a conflict of interest because she had represented family members of an "alternative suspect." Kelley's trial lawyer has vigorously denied that.

King agreed and wrote in a ruling sent to the state's highest criminal court that she believed Kelley met the standard for "actual innocence."

But the court of criminal appeals has the final judgment, which is why Kelley's supporters have long-awaited Wednesday's ruling.

this feels like the right kind of closure, but five fucking years to get it right seems excessive. others have waited longer, i suppose.

wilco's justice system is an absolute fucking joke.

Michael Morton is one of them.

Yes, fuck that whole county.

He's getting married in a couple of months - I think Wilco should pay for a reception and also what he is due for a false conviction.

That old Shaggy thread sums it up very well.  Hindsight is a bitch, I may have taken the deal.  The mom's side of things is compelling.  Sounds like he may end up OK , as far as not much jail time.  His GF sounds hot, need pics to certify.

Username checks out.

I’m glad this has finally been resolved. The state’s case was always bullshit.

Took way too long, and the inept prosecution should have been disbarred... fired... whatever.

Anderson wasn't inept, he was corrupt. And he did relinquish his law license I believe, but can reapply now. No idea if he has.

Kelley on the right and the other guy in the daycare on the left.  I believe the latter's mom owned the place.

Did they end up going after him?

Anderson had nothing to do with Greg Kelly - last I heard, Anderson was in South America working with the poors.  Jana Duty was the DA at the time of Kelly's conviction.

Only curious.

No.  But if you had sex with her, you....did your Duty....

I think that's where the issues started.

Williamson county will fuck anyone over... White/black/guilty/innocent. Don't make a shit to them so long as they can convict anyone and get the case closed. That's pure evil.

What is he due for being in prison for years?

Lawdogs?

How about prosecuted and imprisoned?

You can tell them apart by their numbers.

Are all males at that school required to have the Blake Gideon haircut?

Nice work, Detective Katfid.

Depends if they broke any laws or not. The Surly lawyers could elucidate on that aspect.

"How are these not the same person?"

Anyway, Greg's girlfriend lives in our old hood in Leander. I guess he used to be a personal trainer at that gym in the Rail Yard, and he was my friend's trainer for a while. She was so happy to hear this news.

CEDAR PARK -- A judge on Wednesday has found Greg Kelley innocent after he had been sentenced to 25 years in prison after being convicted of super aggravated sexual assault of a child in 2014.

District Judge Donna King overturned that conviction.

“I declare you innocent, and you are fully exonerated,” King said from the bench. The courtroom erupted in applause.

The decision allows Kelley to apply for money under the Texas Wrongful Incarceration act for the three years he spent in prison.

Leanderthals.

Other than the general blameworthiness of prosecutors, not sure that cat did anything specifically wrong here.

Young adulthood cut short... Would like to see whose pointing the finger.

So this trailer makes it seem like there are still questions about his innocence, but maybe it’s just a tease.

Declaring Greg "innocent" was only half the job.

The DA needed to be declared "guilty" and sentenced to prison for the job to be finished.

No victory in this.  She should have died in a cell, alone and cold.  Not in Rockport eating Blue Crab.

I started a thread about the documentary in Movies and TV. Should've checked here first.

Still on duty Cedar Park detective Christopher Daniels can eat a hug bag of dicks. We citizens are going to pay out millions to Kelley due to his "investigation." Chief Mannix retired early but is still named in the suit.

Yep, they run their phoney "investigations", get away with it 99.9% of the time, and then fly away like the cockroaches they are when the light gets turned on.

Leaving the taxpayers holding bag of shit, as usual.

Rinse/Repeat

Per the documentary, the detective in charge of the investigation (Daniels) never went to the house where the abuse allegedly took place, nor did he investigate or interview any other possible suspects.

Because he knew some of the relatives involved, IIRC.
And his attorney (Patricia Cummings) represented his brothers in other cases . Im not saying they're related, but every time it was brought up that "hey, Johnathan looks like a smaller version of Greg" Cummings responded with "we're not going there."

But detective Daniels conducted one of the laziest investigations all time.

when did the filmmakers interview Mannix?  because in this first episode its sounding like he was talking like the day after the conviction because hes acting like his shit dont stink.

obviously he was declared innocent in Nov, and Mannix quit a few months ago. But he still has the cocky "fuck you Im the police chief and cops cant do any wrong" attitude in the interviews so far.

It's allowing me to watch the next four episodes on Hulu even though they havent even been aired yet.
