April 20, 20205 yr I owned a business 13 years ago and today received a letter from Ken Paxton that I have 10 days to respond. I did walk away from the owed sales taxes. Is this still collectable by the State or will they sell it off to a collector?

April 20, 20205 yr How much are we talking here? 10k? 100k? More? The answer to that would alter how concerned I'd be.
April 21, 20205 yr So you COLLECTED the sales tax, you just failed to REMIT it to the state. There's a word for that. Fucked.
April 22, 20205 yr I can tell you those people are dicks, will not settle for less and will come seize shit that they think you might own and keep it till they get paid. Best hope is to get on a payment plan if you can't pay the full amount.

April 23, 20205 yr I don't know the details in Texas, but there has to be a statute of limitations involved here. I would call a tax attorney. Seems nuts to be coming after you 13 years down the road.
April 23, 20205 yr I'm not a lawyer but I think the statute of limitations is different if it's a filing mistake vs fraud or not filing a return at all

April 29, 20205 yr They are going to want interest too. Whatever happens, validate every penny they say you owe. I’ve been involved with corporate sales tax audits and have successfully renegotiated some of the bull shit extrapolations the tax auditors proposed based on limited point of sale data.
April 30, 20205 yr I'm speaking in terms of Alabama law. I'd think Texas is similar. They have established a liability within their statute of limitations. Because the liability was assessed when it was within statute, you are still liable. You owe the tax/interest/penalties. Call them to set up a payment plan or close all of your in state bank accounts, sell all off your in state property, or move north and/or west and don't leave a forwarding address. They'll put liens on any property they know that you own and garnish any bank accounts that you have. And as previously stated, if you collected the tax and didn't remit it to the state, you're a thief Edited April 30, 20205 yr by retsevlys
