You see, it's not only Democrats out to get him but a good percentage of Republicans as well. You know, the Deep State establishment Republicans, who barely recognize their party anymore. His paranoia must be overwhelming.

I have to tell you--I'm powerfully uncomfortable with raiding lawyers' offices.  I recognize that in a lot of circumstances, the lawyer isn't acting as a lawyer, and so the materials aren't privileged.  But an investigator needs to be real circumspect about that kind of thing.

Correct me if I'm wrong, but privileged information can't be used as evidence anyway?

Hearing the news of the FBI raiding Trump's personal atty followed by catching Trump's meltdown live left me with a similar feeling.

The Manafort/Gates indictments came 12 weeks after Manafort's no-knock pre-dawn FBI raid at home.  It's not going to be quiet for 12 weeks now.

Likely crime-fraud exception to privilege applies:

Quote

The crime-fraud exception can render the privilege moot when communications between an attorney and client are themselves used to further a crime, tort, or fraud.

Thanks.  That is what I was looking for.

Seems that if they applied that more frequently a lot of DC lawyers would be looking for paddles.

Anyways, I think Trump is gonna be baited into firing Mueller.  It's gonna lead to his downfall but he won't be able to help himself, he'll tip that first domino over himself.  And Mueller will be lighting up a cigar the minute he does it.

Edited by ChiTownDoc

The state of despondent vexation that Trump is about slide into will result in some bombs being dropped in Syria and maybe even Iran.  I'm not sure who gets fired first between Mueller, Rosenstein and Sessions, but they're all as good as gone.  John Bolton is about to ejaculate tiny mustaches with tadpole tails all over his adult mustache.  And this Congress has proudly displayed that they're perfectly willing to do absolutely nothing about any of it.

The malaise of Trump's most recent chapter of brooding existentialism will have a cost.  The times where he stumbled around and angrily mumbled about what he saw on television are about to be considered the good ol' days.

Whatever happens, the midterms are all that matters.  I see no possible way it’s going to get any better for the GOP.

Apr 3, 2017 - President Trump's longtime attorney Michael Cohen will be a deputy national finance chairman of the Republican National Committee, the RNC announced on Monday.

Did Trump say "they found nothing" literally while the FBI was still logging Cohen's property?  Not that the truth even matters anymore, but I just don't want to forget how to giggle.

I kind of want the Stormy Daniels stuff to go away.  If he goes down for campaign finance violations due to paying off a porn star, I feel that the actual crimes (in the public eye) will go under the radar.  It's easier for trumpkins to shrug off a porn star issue than a fucking traitor issue.

I have a feeling Mueller is at the end phase of his investigation. The fact we had coordinated raids today tells me they aren't worried about any other firms having relevant dirt.

Any information collected during the execution of the raid on Cohen is free reign for mueller, right?

I doubt it because it wouldn’t be uncovered in investigating election issues like his jurisdiction order says.  It would be uncovered by an unrelated department looking at unrelated issues.

If that’s the case seems like mueller is conceding that Cohen had nothing of relevance to his investigation.

There's some experienced talking heads (Frank Figliuzzi for one) saying the same.  This is an end game type move.  They knew specifically what they were going after and where to find it.

However, it stands to reason there could be an extensive web of information contained within that grab.

Special Counsel can investigate tertiary issues in order to obtain cooperation from key witnesses.

Very notable.  And I share the other attorneys' discomfort with this.

If it's bad enough for a lawyer's office to get raided...it's bad.  Or it damned well better be.

Shit, my phone can be a portal to client information.  My simple plan, if any law enforcement tries to confiscate it and demands access is "good luck.  Try the passcode till you brick it, I'll buy a new phone."  That's also why I don't enable biometric access (fingerprint).  Numeric code only.  They can't compel you to give that up.

And let's be clear, I'm not doing anything worth hiding - It's just that we lawyer types generally take that "keep client info confidential" requirement seriously.

As for Cohen...who the hell knows what all he got into. It's telling that his only client of any significant appears to be DOTUS.  That tells you he's less of an attorney, and more of an idiot on retainer.  But we'll see what comes out.

Both Cohen and Trump's people have said that Trump knew nothing about the Stormy Daniels payout so there is no client-attorney privilege for investigating that matter. Thus it could be an election law violation investigation into illegal donations(hello John Edwards). If they find Cohen and Trump conspired to cover up a Daniels payment you move into the crime/fraud exception to client-attorney privilege.

A search warranty means they convinced a federal district judge that there was a time sensitive manner with documentation destruction fears to not go through the normal subpoena route for attorney's documents.

The hits... they keep coming

Former Trump campaign chief Paul Manafort has trouble in his own house. According to court documents, one of Manafort’s former employees led an FBI agent to a storage locker filled with paperwork on Manafort’s businesses and finances. The person’s name is redacted from the filings. But he’s now at the center of a fight over evidence that could play a significant role in the government’s case against Manafort.

“People do strange things when confronted with authoritative FBI agents,” said Sol Wisenberg, a criminal defense attorney with Nelson Mullins.

This makes the second Manafort associate known to have aided the government in the sprawling investigation into foreign influence in U.S. politics. Rick Gates, Manafort’s long-time right hand, began cooperating with Special Counsel Robert Mueller’s office in February.

Or maybe Mueller just found out about other criminal activity by Cohen and passed it on to the relevant authorities. Why does it have to be one or the other?

Why not both?
