I have an employee who is having a tough time getting along with everyone else at our workplace. He is extremely unhappy but is really bringing on himself. Anyway, if he wants to claim unemployment after giving his 2 week notice, what options does he have? He cant be off work for any considerable time and make his rent. Is this a difficult thing to get, claiming unemployment after you quit a job? What would help his case (like starting an HR case for work environment issues)? Is it next to impossible to get unemployment unless you are laid off in Texas? Or will a note from me do, as they say, and it is quite easy to get and nothing to worry about?

I do want to help the guy but its becoming a real issue with both him and most of the other employees.

Doesn’t exist. I applied after resigning as a trailing spouse and wasn’t approved. Unless laws have changed in the past 15 years.

Not a lawyer either, and typically am on the receiving end of resignations.  HR treats a written resignation like a "Get out of jail free" card, with regard to unemployment cases.

Help your employees who want to be there.

Your heart is in a good place, but I think you should be helping him acclimate better or suggesting others companies/jobs where he might fit in better. You are doing him no favors long term by getting him on unemployment.

Can you strongly suggest that he look elsewhere? At the end of the day, you’re not responsible for other people’s life.

Fire him so he can get unemployment but don’t tell any reference checks that he was fired.

He sounds like he posts on this board

I would fire your employee. It sounds like you don’t want him there, but you want what’s best for him. A severance + unemployment could give him a chance to start over. If you fire him, please work with your HR so they don’t contest his unemployment claim.

He 1000% won’t get unemployment if he resigns.

Texas could be different, but you typically don't get unemployment for resigning. You get unemployment for being laid off or fired.

If you're fired for cause and the employer has any kind of documentation at all, the fired employee ain't gonna get shit.

Asking for a friend....?

You know way too much about this guys situation for it not to be yourself, lol

Jeez, OP, if the guy can't get another job in this environment, he's not trying.

No shit

Tell him his new job is to find a new job. And he can work remote for the next 60 days. After that, he’s on his own.

This is actually a good idea. I think I could only afford to pay 30 days on a deal like that though.

Unemployment claims reduce an employer’s UI balance usually resulting in an increasing tax rate in future years to replenish it to benchmark levels. In other words, firing vs allowing him to quit costs your company money.
