Sounds like victim is Beard’s fiancée. Allegedly wants charges dropped if Beards attorney is to be believed. Although sometimes the dropping of charges isn’t up to the victim.

So basically it will come down to is the DA an aggy, frog, tech, or sooner?

Calling the cops, however...

Best part about that scene...it takes place in Austin.

You’ve repeated that a couple of times. We don’t know that.

This isnt a movie. Cops didnt burst in a door and catch him in the act of choking someone.

If true, the "daughter's boyfriend!" crowd is going to look like fools for trying to wishcast this away.  Especially whoever started it.

Some people are just shitty and violent.  Beard may be that.  He won't be head coach at Texas by the end of the week.

Maybe the daughter's boyfriend was banging his fiance, smart guy?

I'm not sure we need to be posting giant GIFs of Beard's girlfriend.  I mean, yeah, it's surly, but . . . whatever . . .

Somebody is bad in the sack

So is Tech's current coach any good?  Do you think we could have him in Austin by tip off tonight?  Might be worth it just to piss off Tech fans some more.

What is the difference between an angry rooster and an attorney?

 The angry rooster clucks defiance

More often than not, when police arrive, the incident is usually over. They'll speak with both parties and look for evidence supporting either story. In my experience, when a CW alleges strangulation, police will not usually arrest someone on a felony charge unless there is some evidence to support. Typically, we're talking red marks, discoloration, etc. on and around the throat, AND CW alleges difficulty breathing - even for a moment.

But every cop and agency is different. Speculating is fun, but the evidence could range from "he said, she said" to "she was unconscious on the ground with a discolored neck."

I'm certainly a lot more comfortable drawing premature conclusions about an adult in a leadership position that was arrested at 2AM on a Monday for felony assault than I am running with the narrative that, "Hey, maybe his daughter's boyfriend is a rapist." A teenage boy that, if he even exists, is being tracked down by internet sleuths as we speak.

Huh? Are you privy to the police report that hasn't been released yet? You realize the cops don't actually have to be an eye witness to something in order to arrest someone for something right?

Surely he is arraigned today and out on bond. Given we have a game tonight, there has to be a statement made by either him or the University well before that. It's not like he can just show up and coach today as if nothing happened.

If the victim is the fiancée and it’s true that these two have a rumored messy relationship which includes (back to Lubbock days) DV…we have to cut bait. Whether she files or not is irrelevant. What if these two get in another alleged DV instance and someone is hospitalized or killed and he’s still coaching here? Do not want that.

I say this (all things considered) based on if all the above is true. I do not want that. They need to break up and get therapy and move the hell away from each other. The end game here isn’t some beautiful long lasting relationship Hallmark movie.

Well, using a paper bag over that face could technically be constituted as strangulation.

In no way whatsoever does that support your statement that he was choking her when they got there.  "Incident" is a general term here and "in progress" referes to when the call was made.

Back in the early 2000’s I was casually banging crazy chick that decided she was going to beat the shit out of me. She had some bumps on her from me deflecting her stupid punches, but had she called the cops, I’m pretty sure they would have hauled me in. We were all alone in my apartment and I had barely a scratch on me. Not saying that is what happened here, but there are sometimes 2-sides to a story.

Regardless, if you’re a 49yo millionaire you need to never be in that situation. Very poor judgement and warrants what is coming his way.

Yes, in progress at the time of the call, not at the time of police arrival on the scene.

I've heard horror stories of guys defending themselves from drunk girlfriends and being hauled to jail. Honestly the optics are so bad he's probably going to be fired no matter what the facts say, so he's gotta go.

On the specific topic of whether he "tried to strangle someone to death" I agree with the posters saying let's wait for the facts to come out. I want to hear more facts before I say he's an attempted murderer. But right now it doesn't look good at all.

cases like this are a dime a dozen

1 hour ago, BTW said:

I'm not saying anything like this happened, but time for a CSB ...

I know a guy who was charged for this exact thing a few years back.

He and his wife were drunk late one evening and had an argument at their house. She started to get violent.  He was trying to restrain her from hitting him and was holding her arms with his hands when they went to the ground.  While still holding her wrists in his hands, his forearm ended up across her neck which was enough for her to stop the struggle.  When he let her up, she locked herself in a room and called the cops.  They arrested him on this same charge and he spent the night in jail.  The next day, when everyone was sober, he realized he should have just left the house and she realized that she overreacted in accusing him of choking her (she told me this directly).  The charges ended up being dropped and after some counseling they are still married and have put it behind them.

All that to say, we do not know the facts yet, so I will reserve judgement until they come out.  Once they do, if he really did strangle someone, he needs help and jail and a new career.

textbook assault - family violence - impeding breath or circulation arrest in Texas

1 hour ago, field said:

Assault is typically a Class A misdemeanor.  Except, it is considered a 3rd degree felony if committed against a member of the household/family etc. and "the offense is committed by intentionally, knowingly, or recklessly impeding the normal breathing or circulation of the blood of the person by applying pressure to the person's throat or neck or by blocking the person's nose or mouth."

So, under the Penal Code, placing your hand over someone's face could be considered impeding normal breathing sufficient to be charged with the offense.

correct

1 hour ago, Rickylovesweed said:

It was already noted earlier in the thread that boyfriends fall under that umbrella for this particular offense.

your daughter's boyfriend is not family violence unless he lives with you

Granted, my knowledge of Criminal Courts is mainly from Law and Order, but won't the prosecutor lay out exactly what (allegedly) happened to the judge in a bail hearing? And shouldn't that be in a few hours? Assuming you can't just bail out of felony charges.

no hearing, magistrate determines PC based on the PC affidavit, which will be public and I will post a copy

As a Longhorn alum and fan, I have always held Longhorns to a higher standard.  If a coach is convicted of a felony, that coach should no longer be our coach.  I also believe strongly that the evidence needs to be reviewed before making such a decision.    As a Criminal Defense attorney who has handled 100s of family violence cases, I can say that this offense is the most wrongfully arrested crime I see.  Once the 911 call is made, someone is getting arrested.  Normally everyone involved is drunk and angry including the complaining witness.   The first thing some officers say is "If he choked you, we can arrest him a felony."  Some people can get mad and drunk enough to think a good way to end an argument is to get the other party arrested.  There is often no physical evidence or neutral witnesses on impeding cases.  Most are he said she said cases.  It also goes both ways as I have also handled cases where there is no doubt what happened, and the person charged is a piece of shit.   I do not know the facts in this case and would hesitate to rush to judgment.

same and absolutely agree, most charges are bullshit

Not trying to excuse what Beard may have done, but I had a buddy who was once arrested for DV even though it was his wife who repeatedly struck him and he just pushed her back. She fell and called the cops and they took him in. Later they saw bruises on his body and let him go and never filed any charges. Not saying that's what happened but these things happen sometimes and people almost always blame the guy without knowing all the facts.

happens all the time

31 minutes ago, Dbeasy said:

The reasoning above is something I’ve personally seen happen. And as I said earlier, Austin police officers are under pressure to treat family violence events very carefully and often arrest someone to sort it out later. They want to protect the potential victims from further violence.
