No, they won't.

See Leach v. Texas Tech University

I thought every coach after Leach got their University to waive sovereign immunity in the contract?

Yep. There it is.

Rule #1 of PR when you're caught doing something wrong: Get ahead of the accusations.

I hope every one of you retarded motherfuckers (who said the legal process matters and that Beard's actual guilt matters and that CDC/Texas would never react quickly) read this letter twice. And fuck you.

Get help. Seriously. There is something wrong with you. This is absolute aggy "yay we just hired the great Petrino" levels of dumb.

Ooof. Yeah. Minton did Beard no favors with this letter. How can anyone be so dense?...

You didn't read UT's letter. Bless your heart. Go give it another try. We're waiting.

...oh. That's how.

And he would have been fired if he injured someone. I know. I’m just saying, the university definitely frowns upon it’s employees having mugshots

Yup.

Just now, Texas Wahoo said:

I've already expressed my opinion that he arguably did not if he did not do the "conduct" that led to the charge, but obviously most people disagree.  My guess is it is enough to get into court, but it will depend on the judge.

you mean that his conduct of dressing up in a prison uniform and telling the judge he didn't choke his wife and how much to get out of here isn't unbecoming for the head basketball coach of UT? Weird, because I'm pretty sure any layperson thinks that is unbecoming behavior even if it was a Halloween costume and joke and not real life.

What CB and his attorney are failing to grasp is that he may be innocent of beating his wife but he's not innocent of embarrassing the university.  This sucks.

A US Congresswoman had to resign because SHE got revenge porn'd by an ex.

At the end of the day, nudes/bad PR/mugshots are going to piss off your employer, whether it's a University, your voters or the corporation who signs your paychecks.

Yes this is what happened here too. She got revenge porn’d.

This contract will be in court for a long time and Texas will end up paying out a decent chunk of it.

Not really.

If she ever gets to being his wife, then he has even more bad judgment than I thought.

Just now, immamac said:

what if beard resigned and then the university was like aha you are sorry so we'll let you stay and that was the REAL test that Beard failed?

Beard's Kobayashi Maru.

He should have cheated.

Beard can take the year off, get his charges dropped or reduced, rethink his life, and get back to coaching somewhere else. UT did the right thing by moving on.

If they are basing his termination on the "unbecoming" portion and not the charged with a felony portion, it is definitely going to court, which is my point.  I think Beard has enough to at least get a trial, including discovery, which I imagine both sides would prefer to avoid.

that line read like he pissed off some major decision makers badly..

Or perhaps he thought he was golden once she officially recanted her initial story.

The sad thing is he's going to need her to continue recanting the story in order to land his next gig.

Goodbye GIF

I was extremely confident that Texas would win a National Championship under Beard. This has been a continuous kick in the balls for the past 3 weeks. Fuck Beard for not being able to control himself and keep his hands off his woman. CDC has shown the ability to make awesome hires and Texas is a fantastic job, we will get our guy eventually.

He was in a physical fight with a woman which ended in a 2 am call to 911.

Speaking of which. Wonder what that call sounded like and who got to hear it.

I kind of find it humorous that UT gave him a couple of hours to think about resigning...knowing full well there was no way in hell he would (if he resigns, there is no suing UT later for not paying him).

It's almost as if the UT attorneys were bored with the lack of competition on the other side of the table and decided to have some fun with it.  "Hey, let's offer him the chance to resign....bwahahahahaha".

I believe the Texas Legislature must waive SI.  I don't know if they did that here, but I doubt it.  My understanding on getting around SI is to get a non-State of Texas entity to guaranty the agreement.  Many alums would happily do that to get a big name coach.

Please explain to me how any part of this situation is not unbecoming?

You think willingly or unwillingly, regardless of the situation that

THIS DOES NOT QUALIFY AS UNBECOMING?

Kind of curious about the part of Minton's letter referring to CDC assurance that he thought Beard was innocent.  Wonder what kind of documentation they have on that?

I doubt seriously A&M can just walk away from Jimbo’s contract.

"Say, do any of you guys know how to Madison?"

Welp, sorry not sorry Beard that you lost your way and ended up here

Meh, pictures of Captain Caveman handing out fake bills in Whataburger bags to football players was all over the news. UT survived.

He kept his job because no one knows who he is.  His crime didn't make the national news.  For that matter, did it even make the local news except for the school newspaper?

Beard's incident made national news.

That's the difference.

Edit to add:  I'm not defending it.  There shouldn't be separate rules in incidents of domestic violence.  I'm just stating why he wasn't fired and Beard was.

Not exactly equitable to domestic violence.

Reminds me of Patterson telling recruits Brown was staying.  Except I believe that happened.

I don't believe for a second that Del Conte told Texas players that Beard would be fine. I'm sure the Texas legal department had a gag order on all personnel, if not an actual rag inserted into their mouths.

If UT is going to stay out of court, they are going to have to prove they win even assuming the facts are as Beard alleges.  So assuming that he alleges that he is totally innocent and never did anything physical, then what is the conduct unbecoming?  Being falsely accused of a crime and then being falsely imprisoned for that crime?

Obviously that is probably not what happened, but if UT is going to avoid a trial altogether, it's difficult to do on a loose standard like "conduct unbecoming."

2 minutes ago, CTC2 said:

Well, unless the State of Texas effectively waived SI, it can.  I suspect some very rich ATM alums happily backstopped the contract.  They (unwisely) thought they had a national championship locked up.

You have a very clear misunderstanding of what's going on here. His innocence or guilt is immaterial. Getting arrested is more than enough cause for UT to fire him. Full stop, end of story.

None of this matters. He was arrested and charged. End of story.

Yep - those morality/public image type clauses basically give the University an out for bad behavior.

5 minutes ago, CTC2 said:

Even if they legally can, I doubt they would.  A&M got Jimbo because they were willing to offer more guaranteed years.  If coaches know those guarantees are not worth anything, it will be difficult to get the same level of coach.

It doesn't matter as much for Tech, because Tech is generally not looking to hire that quality of coach, so the guarantee matters less.

14 minutes ago, immamac said:

You joke, but there's an outside shot he could return as the head coach years from now if he had resigned, showed contrition, and carried on his life as a model human. Having failed to do so, he lost even the remotest possibility of that coming to be.

This contract will be in court for a long time and Texas will end up paying out a decent chunk of it.

Texas will gladly trade money to keep the brand untarnished.

I guess we'll see if Beard ends up suing.  My bet is it is not thrown out immediately, but obviously I am in the minority.
