Actually, he didn't use campaign funds.  That's what he thinks exonerates him.

The money paid was for the primary benefit of his campaign/candidacy, and the "services purchased" thus were in-kind campaign contributions that he reimbursed.

Ok so let’s assume the accounting is/was accurate and the prosecution really can’t trace the money to campaign funds… why is it illegal to pay a couple of hoes to stfu?

The direct payment to her was from Michael Cohen, not the campaign.  that's not the issue.

The accounting wasn’t accurate. If it benefited his campaign, it should be shown on his disclosures as a campaign contribution either from the Trump Org or Michael Cohen.

It isn’t. It’s illegal not to report it as a campaign contribution. You see if you run for public office you have to disclose when you receive contributions. It’s kind of a big deal.

Falsifying business records to commit another crime (campaign finance fraud) is a class E felony. Hence the 34 felony counts

That I suppose is a bit of a rub.  I suppose all they have to prove is that one motivation was to benefit the candidate/campaign.  For the Daniels transaction, all you may have for that is Cohen's word.  Maybe Avenatti's (lol).  But for the McDougal thing, you have Pecker's word for it's purpose communicated to him, hopefully by Trump as well as others.

And it's not just reporting.  The amounts of the contributions exceeded the limit for a personal contribution (if made by Cohen or Trump) and corporations are still unable to make any contribution to a candidate directly.  And that's an even bigger deal.

But here's the weirdness, they aren't trying to convict him of the campaign finance violation.  They're trying to convict him of falsifying records for the purpose of committing a crime, which was the campaign finance violation.

That's been done several times in NY, but for state campaign finance violations (similar).  So the defendant is convicted of the campaign finance violation AND falsifying records.  I don't know exactly how they go about proving a federal crime that he can't be convicted of in NY court.

That’s all correct. My question is how “in-kind campaign contribution” is defined under the applicable statute. Is there any language that speaks to “primary purpose”, etc.?
Are we really back to the defendant has to state “one of my motivations to make this payment was to benefit my campaign” in order to find him guilty?

Is it too much to hope that Trump was stupid enough to text or email Cohen about this (which would not be protected under a crime/fraud exception to the attorney-client privilege), and that Cohen turned over such communications to the DA?

What would Trump have to say in text etc. in order to reveal intent to benefit the campaign?  "She needs to stay quiet or it's going to hurt our chances in the election?"

I looked at a pharmacy investment about 10 years ago and had a healthcare attorney look at it. It looked really good to me but he drew some buckets on his whiteboard and showed dollar for dollar how distributions matched volume of prescriptions sent by the individual investor. He said prosecutors follow the money and if it matched up you are fucked no matter how you layer it or what you call the different “buckets”

I 100% agree with you it’s obvious as fuck. But I don’t think trials work this way.

My bet is he weasels out because the DA can’t really prove the intent to help the election. My gut tells me the DA is over zealous and caught up I trying to make a name for himself and doesn’t have a strong enough case.

Which is the best case for Trump. They tried to persecute me but I am too strong for them!

Would love to be wrong about all of that.
