Robert Kaplan, Ms Carroll’s lawyer, quickly responded in a statement first posted by The New York Times journalist Maggie Haberman on X.

“We have said several times since the last jury verdict in January that all options were on the table,” she said.

“And that remains true today – all options are on the table.”

Despite Mr Trump’s false claims in his Truth Social post, a civil jury last year found that he did sexually abuse Ms Carroll in Manhattan’s luxury Bergdorf Goodman department store back in 1996.

Ms Carroll said that she and Mr Trump randomly bumped into each other and they got chatting, before Mr Trump pinned her against a wall in a dressing room and sexually assaulted her.

The jury also found that he defamed the former Elle magazine columnist when she came forward with the allegations. She was awarded $5m in the verdict.

In a second civil defamation trial in January, Mr Trump was found to have defamed Ms Carroll when he accused her of lying about the attack.

The former president was ordered to pay Ms Carroll $83.3m in damages in that trial.

Despite the rulings, Mr Trump can’t seem to stop lashing out at Ms Carroll and has lodged an appeal.

His rant came hours before closing arguments were set to begin in his criminal hush money trial in Manhattan.

The former president is charged with 34 counts of falsifying business records over a payment made to adult film star Stormy Daniels ahead of the 2016 presidential election – in a move to silence her about an alleged sexual encounter in 2006, months after Melania Trump gave birth to Barron.

Prosecutors allege Mr Trump’s “fixer” Michael Cohen made the $130,000 payment on his behalf and Mr Trump then reimbursed him after entering the White House. He allegedly fraudulently recorded the reimbursement payments as legal expenses.

The charges have been stepped up to felonies as prosecutors allege the former president committed the crimes in commission of another crime: to influence the outcome of the 2016 election.

After weeks of testimony, the trial is now nearing its end, with jurors set to begin deliberations as soon as Wednesday and decide Mr Trump’s fate.

I assume the jury will be sequestered until they rule.  When I was a bailiff, I had a bad situation where the jury was sequestered mid-deliberation at a local motel.   One of the guy’s sons did not know dad was doing jury duty, but thought he was cheating on mom at the motel ‘cause he spotted his car.  One of Spokane’s finest saw the kid peering in a motel window.   The kid and the officer and the motel manager tried to come see the dad, but I stopped them and said they could not speak to my juror.  Cop cared not for a bailiff and got bowed up and said he “was in charge”.  He put his hand on his holster.  I had a Smith model 36 ‘Chief’s Special’ 38 snub nose as my service weapon, and told the guy to chill because I could get to my gun quicker than him - and neither of us needed to be shot over something so stupid when we could call the judge and get his input.  

My judge was bigly unhappy and tore the cop a new asshole for almost causing a mistrial in a week long rape-murder trial.

Surly is awesome. Texas coming to the SEC makes us better in every sport, and increases our academic prestige. I think only 3 or 4 SEC institutions are AAU members. I know this won’t be popular, but Texas and Florida are very similar in academics and athletics, granted not with your past history. Both Big-Brother land grant universities, both hated by the A&Ms and FSUs of the world because we are what they ain’t.

So more on Cannons latest. Apparently at 530 pm on Friday the government sent Trumpco an email about their gag order motion, which was formatted as a condition to avoid pretrial detention,which is actually a bit more serious than the other gag orders, enforceable only by contempt. This would be to revoke his "bail" if he violates the conditions. 

Trumpco offered to review and discuss on Monday. The government declined and filed on Friday. And declined to identify the statements by Trump on which it was based (those referring to lethal force by the warrant team and to planting evidence). 

It was Jay Bratt on the motion.  The details may be off but this is the gist of it. 

That was a bit of a dick move by the government, even if it was likely futile. Pretty aggressive at any rate. 

The saving grace for the government is that they were apparently candid about the non-conference instead of pretending that they really did confer. 

You could rightfully expect just about any US District Judge in America to do what Cannon did here. Trumpco asked for sanctions and she declined.

I wonder if the jury has any kind of inkling that the consequence is just a fine, and so a guilty verdict isn’t a big deal or a tough choice if the case is well proven.  Which would be why his attorney put it in their minds that a jail term is a possibility.

You're probably not wrong about him simply getting just a fine if found guilty. But, to my knowledge, the maximum penalty could be up to four years. Of course, he'd appeal that verdict, which would last forever. 

Edit: I don't know who does the sentencing in that case, whether it would be the judge or the jury.

The Judge sentences.   One of the things affecting the potential sentence is lack of contrition and refusing to admit that what you did was wrong. I’m sure Trump will be humble and contrite if convicted.

I am also sure that the judge will completely ignore all of those attacks on him and his daughter that put his family at risk.

The comment about prison was massively improper because it is not the jury’s role to determine punishment, and there is also a pattern jury instruction specifically telling the jury not to consider possible consequences of the any verdict.  Using the P word was intended to make them wonder if they were going to be the first ones putting a former President in jail, which could give some people pause regardless of their thoughts on his criminal culpability. 

And no, I am not saying this because I think he will serve time, but all the judge said was that imprisonment was not an automatic required response to a guilty verdict. He also did not say that jail time was absolutely out of the question.   30 days would make a point about no man being above the law.  If he is convicted, that is my preferred sentence - to shut up his Jean Valjean imitation - like he suffered 19 years unjustly.

Is the jury's determining his sentence an option in NY?  So far, everything I've read has indicated that the judge will determine his punishment if he's found guilty.

I don't know the answer to that question, but the issue seems to be the jury even considering possible sentences while deliberating innocence or guilt.

Correct.  I understand the objection to the defense's argument.  I was asking separately whether the jury's determining punishment was an option.  It is in Texas.  It seems like maybe not in NY.

Thankfully, judicial bias is a very steep hill in a criminal appeal.  Also, it might be a pretty fun run at the invited error doctrine to spend 5 weeks trashing a judge and his family in every known media form, then cry bias.

Yeah....I once had to answer for a (very green) judge the question of "so, what is your authority for the argument that I can grant summary judgment on just part of a claim?"  I didn't handle it well, as I answered "you mean....other than the rule, which says you can move for summary judgment on 'all or any part of' of a claim?"  And she said "yes, other than that."  I told her I'd get her a short letter brief that afternoon, which I did - I literally had to type out the exact text of the rule and I cited about half a dozen exemplar cases where the court did exactly that.  

In fairness, she got it right, and learned quickly.  And she may also have been super-nervous as it was literally her first day on the bench.

But some of these ideologues that were appointed last term....they're flat-out dumb and bad at being judges.  And setting aside politically important cases, everyday practitioners are going to have to deal with their idiocy and incompetence for decades to come.
