“Judge Kavanaugh last night and it further solidifies my opinion that he’s a thoughtful and reasoned constructionist conservative when it comes to applying the law. Meaning he is bound by Stare Decisis or Judicial precedent.  In layman’s terms, he follows the prior rulings of the Court and doesn’t aim to make new law. Take for example his dissenting opinion in Garza v. Hargan (2017) - the ‘abortion’ case reflects anything but a mission to overturn Roe v Wade. His dissent specifically states that the government has the right “...to impose reasonable regulations so as they do not unduly burden the right to an abortion that the Court has recognized.” That sounds to me like he’s acknowledging that even an undocumented immigrant minor has a legal right to an abortion...

A couple of things:

1. It would be incredibly ballsy (aka, idiotic) for a lower court judge to provide a new decision on abortion (or any subject) that contradicts a SC ruling.  It would obviously be appealed and not stand.  That doesn't really inform us, one way or the other, about whether he feels the SC should continue to respect past SC decisions.

2. It seems unlikely that Kavanaugh would suggest directly overruling RvW.  Even if he did, he wouldn't have four other jurists who joined him.  The concern is whether he would consistently rule against abortion rights absent any obvious, direct contradiction to precedent.  My guess is there is a good chance he would, but I haven't really studied his opinions and don't really have the background to do so adequately. 

So I think abortion rights advocates have reason to be concerned. I just don't think there is a hell of a lot anyone can do about it.

Are there people who truly feel that socialism is a good path for the US? What is the incentive to work? If people don't have incentive to work, doesn't society collapse? Who bakes the bread? Who harvests crops? Wouldn't the smartest, most productive, and most creative people stop working if they could not receive proper incentive for their work? Even if you did receive proper incentive, you wouldn't be able to get anyone else to provide you any services so what's the point?

And as I’ve pointed out previously, socialist countries have flatter tax structures.  So the poors and middle class taxes will be going up a lot more than mine.  

I don’t oppose socialism so much for the impact on me, I oppose it because it will devastate our economy.

Socialism is a terrible path for any country.

But socialism is what crony capitalism becomes once enough of the population is fed up. What do you think the odds are that either of the two major parties we have rolls back crony capitalism? Here's a hint that you won't get from your Facebook feed: Democrats aren't actually for socialism. They feed the crony capitalism beast just like the GOP.

So now we have a socialist discussion on the SC thread, as well as the election 2018 thread. 

We have socialist programs and we have had them for a long time.  Social Security is an obvious one.  You can argue that the interstate system and public education are two others, although those are so ingrained in mindset, it's difficult to really distinguish them. 

So is a "socialist" someone who merely supports these programs and wants to emulates them in things like health care and the university system, or does it mean that they want a bloody revolution and eat the rich?  Labels mean less than specifics.

The legislative branch can really only punish the judicial by limiting funding, refusing salary increases, and just stop confirming new judges.    Tell them they have to do more with less.  


Assume the Dems hold both houses. What if they decide to expand SCOTUS and add two judges? Where does the constitution say that 9 is the correct number?

This, I am not a liberal, progressive, leftist or Democrat. As a libertarian, I always related to the Republican fiscal stance up until the election of Trump. Then the GOP lost their fucking minds and went full blown bat shit crazy.
