Some key facts

  • Paxton would be immediately removed from office if two-thirds of senators, or 21, vote to sustain even a single article of impeachment.
  • If any articles are sustained, they can vote to prevent him from holding future offices.
  • The last time a statewide official was impeached and convicted was when it happened to then-Governor James Ferguson in 1917.

Paxton and his wife had some things to say over the weekend

  • Paxton was introduced by his wife, Angela, who announced she is running for re-election for Senate District 8. She called him the "love of my life, my best friend." There have also been allegations of an affair against Paxton."I have also watched this man fight for me, fight for us as a couple," Angela said. "And you can be very sure that he, if he’s doing that, he’s going to fight for you."
  • "What I’m saying to you as we’re going forward, we have to take responsibility for our own party for people we elect who sit there and tell us one thing," Paxton said. "Yeah, we’re all about election integrity, that’s just one issue, behind-the-scenes, because Dade Phelan had to make a deal with the Democrats, we’re taking your ability to stop voter fraud away."
  • "I would love to talk about what’s coming up for me for the next couple of weeks. I have a gag order, so I cannot talk about that, but I can talk about something that has maybe become the leading issue that we deal with as a county and the state needs to deal with and that is something known at the Texas House of Representatives," Paxton said. "Let's clean house. God bless you."

  • Republicans once believed in the rule of law. My party had confidence in the U.S. and Texas constitutions and the processes and freedoms they recognize and protect. That’s why it’s shocking to see some Republicans—through a coordinated effort of texts, emails and social-media posts—working to delegitimize the impeachment proceedings against Attorney General Ken Paxton. It points to an important question: Do we trust the processes outlined in our Texas Constitution or not?

Texas Tribune has the best rundown (check their page for a nice flowchart of all of this)

  • The Senate gallery will be open to the public daily, beginning at 8 a.m., with tickets distributed for the morning session on a first-come, first-served basis starting at 7:30 a.m. on the Capitol’s third floor. Tickets for the afternoon session will be distributed 45 minutes before the gallery reopens. The trial also will be livestreamed on the Texas Senate’s website and at texastribune.org.
  • Lt. Gov. Dan Patrick will act as judge. Senators, serving as jurors, will consider 16 of 20 articles of impeachment. The Senate previously voted to delay consideration of the other four. Paxton’s wife, Sen. Angela Paxton, will sit as a member of the court but will not vote on any decisions or participate in private deliberations.
  • The trial will begin with the court clerk reading aloud the 16 articles. Paxton, who was ordered to appear in person, or his lawyer will plead guilty or not guilty to each article.
  • On the first day of the trial, some witnesses are also ordered to appear outside the front door of the Senate chamber at 11 a.m.
  • The court will begin its work by ruling on pretrial motions. Any motion to dismiss an article of impeachment must be approved by a majority of senators, at least 16 members. Patrick can rule on any other motion, or he can ask senators to vote on a motion without debate or discussion.
  • Patrick can also defer a ruling on motions — including dismissal of an article — until after evidence is presented at trial if that evidence would help answer the question.
  • The House managers will be first to offer an opening statement. Paxton's lawyers can choose to make a statement afterward or wait until they begin presenting evidence. Each side has up to one hour.
  • The House managers’ lawyers will present their case first. Each side has a total of 24 hours to present witnesses and evidence and cross-examine the opposition’s witnesses. After both sides present their evidence, each side will have one hour to present rebuttal evidence.
  • Witnesses will testify under oath.
  • Each side has up to one hour to make final arguments. Following that, Senators will meet in private to deliberate.
  • The 30 eligible senators will return to open court to vote separately on each article without debate or discussion, though they will have three days to submit a written explanation of their votes for publication in the Senate Journal.
  • Senators will submit a written vote on the question: “Shall this article of impeachment be sustained?” For each article, the court clerk will read, in random order, how each senator voted. A finding of acquittal would be entered for any article not sustained.
  • If an article is sustained, the House impeachment managers can ask senators to prohibit Paxton from holding future public office in Texas. Each side would have 15 minutes to argue their position. Approval requires support from 21 senators.

When I read that quote form his wife over the weekend, "Ken continues to fight for us as a couple", this is exactly what I thought of (pos rep).  Ken Paxton, Nate Paul, and God knows who else show up in ubers at this chick's apartment in South Austin.  And his wife considers that, what?  One of the battles in the great war he is waging to save their state and marriage?  Yeah, these are totally normal people we're dealing with here, Texas.  

I like to picture today, the two Texas residents of Mexican heritage, who represent a cartel's business interests in our state being seated in the Senate gallery.  And Ken looks over his shoulder like Frank Pantangeli does at the Senate hearing in "The Godfather" when his brother is seated.  And the gravity of the situation finally hits him.  And he takes the honorable way out.

Oh, once it gets going, this thread will get a million posts - they've structured the trial to move fast, with the time limits that they've come up with.

I don't know if the purpose of imposing the time limits is because they know there's going to be a lot of people watching this and and they want to get it over quickly, or if they've already made up their minds, or both or what.  Or maybe because it's not a traditional criminal or civil case, and is instead an up-or-down thing on each charge on removing him from office (and/or barring him from future office). Maybe some of the hundreds, nay thousands of attorneys on Surly can comment on the time limits they've imposed.

Austin-American Statesman seems to have kicked off the live coverage and you can even see Paxton talking to his attorneys.  What is it with attorneys/lawmakers who can't grow a fucking decent beard if their lives depended on it.

 

$50 round-trip for 30 people?  That's gonna barely cover gas for the round-trip, let alone the driver and you know...the bus rental.  Somebody else is footing the bill for most of this.  I bet I know who.

Also, some of those women looked of working age.  Can you imagine calling into your boss today to tell him that, "Well yes, I had yesterday off for Labor Day.  But I need today off, too.  What?  No, I'm not sick.  I have to ride a bus from Target to the Capitol to protect Ken Paxton from the Democrats.  What?  Yes, I'm serious.  You can't infringe my First Amendment rights!  What?  Well they should be covered by HR.  Look, I'm gonna call Karen and have her explain this to you.  I'll see you tomorrow, boss."

As a civil trial lawyer I'm used to many state and federal judges imposing pretty strict time limits for trial, and even though the lawyers usually ask for more time than the judge allots, the lawyers are usually able to make do with the time they're given.

All that said, 24 hours per side seems awfully tight for a case of this magnitude and the number of charges.  But I trust that Rusty Hardin's team has had plenty of time to plan his case within that time limitation and is going to be fine.

Always good to educate anyone that its Rs that have always gone after Paxton. The people that he's accused to defrauding were republicans. I'm talking about the situation that led to the criminal trial has been delayed forever.

Is it possible that Paxton's defense will agree to certain facts to avoid them from being spoken about in this trial? I assume that he's accepting of the facts being in the supportive documentation but he doesn't want them presented during the trial.

When he called Senator Springer up to be sworn in, for a moment I though "Jerry Springer" and that would have been perfect, but Jerry is not from Texas.  And he's dead.

And Paxton vowing this weekend to "clean house" and take out the Republican members of the House was a pretty bold move. They have plenty of time to bring additional charges.
