Two things that stand out to me.

1. Enforcement is up to the Texas A.G. and it doesn't require an oversight agency. *laughs in Paxton corruption*

2. I am a little perplexed by the exemption for utilities and power gen companies. I believe there are some FERC regulations but I am unsure if FERC regulations are applicable to Texas utilities running on ERCOT. The last time I was involved with ERCOT they pissed on FERC because Texas has it's own independent grid.
