Ratcliffe has already audience tested this in his testimony, noting that SecDef had original classification authority for DoD. It’s an incredibly tendentious argument but of course it worked once before.

Democrats, if they ever return to office, need to get serious about some court-packing.

One thing, though, I believe it would be pretty difficult to "punish" a single judge, because the smallest "unit" Congress addresses is a judicial district.

So, they could punish the DC District Court, where Boasberg sits, but they'd also be punishing a number of Trumpy judges.

Plus, the side effects of further reducing the size and capability of the district courts would have severe ramifications for every day business in a system that is already underfunded, as we have discussed somewhat ad nauseam.

And, the federal district courts are pretty heavily relied upon by the oligarchs to protect their oligarchy.

Worst case scenario, even if nothing happens to Hegseth, Waltz, Tulsi, etc., this has to have substantially impacted the likelihood that troops would follow orders from them to fire on civilians. A soldier is a lot more likely to follow that order from someone he respects than from someone he knows is a drunk clown.

My dream would be for Judge Boasberg to schedule hearings with the DOJ on the Signalgate case and the El Salvador flight case back-to-back to highlight the utter hypocrisy / lunacy of the positions of the Trump administration.  Someone really deserves to get thrown in the clink for this bad faith bullshit, but it will never happen.
