Here it starts. Consumers buying fewer goods, companies laying off employees, increasing reductions in manufacturing, and objective indicators the stock market won’t be able to continue to ignore. We had magical thinking and tariff delays keeping us afloat but that’s over.

Affirmed in all other respects, though.  Told y'all that monetary part was likely excessive.

On appeal, it seems that the monetary award is characterized as "disgorgement," which means coughing up all ill-gotten gains, that is, all of the loan proceeds that were tainted by fraud.

I didn't catch that that was the nature of the remedy at the trial level.

It is unclear to me whether the disgorgement can be recalculated on retrial or not.  Its nature is usually "equitable," meaning entirely in the judge's discretion and not subject to a burden of proof, so that would seem to tend to mean that the judge is free to halve it or quarter it or otherwise reduce it.

I'm in this industry and know it very well.  This up there.  The tariffs really haven't hit yet for a long list of reasons.  They're starting now and it'll take a quarter or two for them to show up on the shelf for a long list of reasons.

Wall Street to me know is like after Bear went bust in 2008.  They thought it was no big deal.  Trump basically laid down a +15% tax on everything and they don't realize it's a big deal.

The only this will make a dent with the idiots is (1) if you do the math for them or (2) their bank accounts hit $0.  That's exactly why Trump lost his shit when rumors started going around that Amazon was going to show the tariff charge as a distinct line item.
