Newsome needs to record one of these dick sucking sessions. Not that it would change anything because the voters in this country are beyond any semblance of salvation but because it would make me lol.

It's fascinating that their rebuttal to "you can refuse legal orders" is "Donald Trump has never given an illegal order".  OK, so all good?

That would be surprising, in that they stand up for artist’s rights. But neither here nor there, as I’m sure nothing will come of this.

ASCAP and BMI will happily accept licensing fees from the White House if the artists haven't specifically opted out of allowing use of their music (I think on a song by song basis but am far from an expert in this area) in advance.

It's outside my usual area of practice, but I've been following these issues.  The performing rights orgs (ASCAP, BMI, etc.) have licenses for nearly every conceivable scenario.

One exception is political advertising and campaigns.  For those, you have to go straight to the holders, usually the musicians.  I suppose because of the political aspect that the orgs don't want to undertake (or artists don't want to let them).  Correction, as DDD notes, PROs will provide licenses for political things, if the artist hasn't opted out.  Many have.

Also, to use with a video, you need a "synchronization license," which PROs don't provide.

Trumpco has lost several of these.

One pain in the ass, though, is when an actual administration does it, that is, the government, the infringement is reclassified a 5th Amendment taking and the suit/claim has to proceed In the Court of Federal Claims.

Interestingly enough, I am literally reading case law on Federal Claims takings issues, including when the underlying act is not authorized by Congress.  This is different, as it's a question of executive (not Congressional) authority, but there are dual tracks here: one might be able to enjoin the unauthorized act as a whole, in addition to bringing a takings claim.  And even on the takings angle, there's an interesting question of what was taken?  Was it the opportunity to license the song, which probably isn't worth much?  Or, is it a diminution of value claim (by playing my song over some nazi shit, you harmed its marketability in the following amount)?  Frankly, I'd love to see one of these artists take on this fucking administration and get as broad an injunction as they can.

Right. I guess the point I don’t have a problem with is the PROs taking money from any source to satisfy the fees the artists are owed. Doesn’t mean ASCAP, BMI, or Sesac are pro-dotard.

Also, sync licenses are granted by the publishers, as you noted
