Going after an Austin plastic surgeon and maybe others on social media. @Ghost of LL and @TwiceHorn and @South Austin and others, thoughts? It’s the law firm that helped get almost $800 million out of Fox News, so I wonder if this is going beyond one plastic surgeon. https://news.bloomberglaw.com/business-and-practice/unitedhealth-hires-defamation-firm-to-counter-social-media-posts UnitedHealth Group Inc. has hired a prominent defamation law firm to counter what it sees as inaccurate and irresponsible social media posts about the company’s practices. Clare Locke, an Alexandria, Virginia-based boutique law firm, is working for UnitedHealth, the company confirmed. A doctor “is using her social media following to perpetuate inaccuracies, which is irresponsible, unethical and dangerous,” UnitedHeath said in a statement. The hiring shows the biggest US health insurer is pushing back against public statements it views as false following the high-profile death of an executive. Clare Locke is best known for representing Dominion Voting Systems Inc. in a landmark $787.5 million defamation settlement with Fox Corp.'s Fox News. Social media platforms lit up with criticisms and even hatred of health insurers following the Dec. 4 murder of Brian Thompson, the chief executive officer of the company’s UnitedHealthcare unit, outside an investor conference in New York. Luigi Mangione, who had allegedly decried health industry practices, faces murder charges in Manhattan. Elisabeth Potter, an Austin, Texas, plastic surgeon, claimed on Instagram Jan. 7 that UnitedHealth denied an in-patient stay after surgery related to cancer. “I had to scrub out mid-surgery to call United, only to find that the person on the line didn’t even have access to the patient’s full medical information, despite the procedure already being pre-approved,” Potter said in the post. One of Potter’s attorneys, Jessica Underwood, said Potter received a Jan. 13 letter from Clare Locke demanding that she correct her posts, apologize to UnitedHealth and condemn threats of violence that the law firm said resulted from the posts. But Underwood, of the law firm Nix Patterson, said Potter’s statements about the insurer were truthful. “Dr. Potter will not be silenced by UnitedHealthcare’s attempts to threaten and harass her,” Underwood said. UnitedHealth said in its statement that it had previously approved coverage of the care the patient received, including coverage of an overnight stay. “Dr. Potter’s claims that she was called out of surgery are false,” the company said. “There are no insurance related circumstances that would require a physician to step out of surgery and it would create potential safety risks if they were to do so.” Clare Locke’s letter to Potter was signed by Tom Clare, who founded the firm in 2014 with his wife and former fellow Kirkland & Ellis partner Elizabeth “Libby” Locke. Firm partner Jered Ede also signed the letter. Before joining the firm, Ede served as chief legal officer for Project Veritas, the conservative nonprofit that goes undercover to expose what it sees as wrongdoing. The truth is an absolute defense against slander and libel. In my unfortunately extensive dealings with United I definitely believe that happened just the way she says it did And as someone who did a necessary fracture surgery today that had been delayed for more than 2 weeks on a united patient, and who fully expects to get an initial denial for a surgery scheduled for this Friday, let me unequivocally say fuck United Healthcare

May 22May 22 Popular Post I have United healthcare for my part D Medicare prescription plan. I got a call out of the blue yesterday from some lady from United telling me I could save money on prescriptions and get money to buy over-the-counter stuff if I would only sign up for this fantastic Medicare advantage plan from united. So I asked her - ”Does that mean I can go to any medical provider in the country if - I don’t know - I get cancer?” She said “no, but you will have excellent healthcare locally and a huge number of people to see.” I asked her if MD Anderson provided services for my cancer that cost me $200,000. How much would that plan pay. She said 50%., As MDA is out of plan. So I asked her, “since I’m a cancer survivor who wrecked up a bunch of bills at MDA previously, why was she recommending that I accept a plan that if I get cancer again will cost me $100,000 out of my pocket? She told me “let me know if you want to change”, and ended the call. There are a ton of uninformed old people who would listen to that sales pitch and not understand the out of system coverage consequences to their pocketbook and wind up in serious financial problems. Why that wasn’t the first question, she asked me - did I have a need for healthcare services not under their local coverage plan- before some stupid hundred dollar over-the-counter drug benefit - can only be described as greed. Assholes. They will have to pry regular Medicare in supplement plans from my cold dead fingers before I go with a Medicare advantage plan. fuck united Edited May 22May 22 by Gatorubet
July 19Jul 19 Popular Post Elizabeth Potter MD of Austin, calls United Healthcare to try to get her patient approved for the lifesaving treatment she needs. Hilarity ensues. Spoiler I’m sharing an actual recent peer-to-peer call that shows what physicians and patients face when trying to get a surgery approved. This call felt as absurd as it sounds. The peer-to-peer call was to advocate for surgery to prevent and treat lymphedema for a patient with breast cancer. Her risk is high and we can perform a surgery to lower it. The doctors from the insurance company on the call were an ophthalmologist with a subspecialty in oculoplastic surgery and a plastic surgeon who currently has a cosmetic practice. Neither doctor has ever performed lymph venous bypass…the surgery I was trying to get approved for my patient. Neither doctor would provide their name or license number. At the conclusion of the call, the doctors told me that they didn’t have the power to make a determination or decision to perform the surgery. They were just there to inform me of United’s decision to deny it. The Medical Decision was not up to the doctors on the call. It had already been made by United. So here I am, appealing again. Medical decisions should be made by doctors who are well informed and patient-centered. Patients deserve access to the care that they paid for with their premiums. ---- Dr. Elisabeth Potter, MD 6818 Austin Center Blvd #204, Austin, TX 78731 (512) 601-4759 Website: https://www.drpotter.com/

(sorry, I missed where you added this to your post somehow, but it can't hurt to have the link here twice) Fuck United and the cowards on the phone with Dr. Potter in this clip. Quote You may know me as the surgeon who posted a social media video in January of this year after being interrupted while performing breast reconstruction for a patient with breast cancer. https://www.instagram.com/reel/DEid-1npNbA/?igsh=dWs5aGVtdGc3OHkw I received a call from a United Healthcare representative requesting details regarding her diagnosis and justification for her overnight stay. In disbelief, I shared my thoughts and that post went viral. UNH then responded by sending me a threatening legal letter demanding that I apologize and delete the post. Their attempts to silence and bully me were not effective, and I shared their letter publicly. The attention that followed shed light on the realities of healthcare, creating space for patients and providers to share their experiences. It also created other pressures that contributed to my current position of financial distress, leading me to create a gofundme campaign as a last resort pay down some of my debt. As a reconstructive plastic surgeon in Austin, Texas with a practice primarily devoted to breast reconstruction, I have provided access to the most advanced surgeries, in network through insurance for over 12 years. I have been a safety net for patients across the country, accepting any insurance payment and not turning patients away due to poor reimbursement. I am one of the highest volume microsurgeons in the country and am known throughout the breast cancer patient community as a strong patient advocate with excellent outcomes. When insurance coding changes threatened access to the most complex and healthy types of natural tissue reconstruction in 2021, I personally took on the task and cost of reversing that change. Working in a broad coalition with patients and other advocates, we achieved a reversal of the coding change, insuring the best options remained accessible for the community. While reimbursements for surgeries continued to decrease and many surgeons left private practice for employed positions with insurance companies, large groups, and hospitals, I remained in private practice where I was able to put patients over profits. In response to the preference of insurance companies to move cases into less expensive outpatient settings, I built my own surgery center to provide breast cancer and breast reconstruction surgeries in a specialized outpatient setting. I invested the remainder of my savings in the practice and personally guaranteed loans and took on additional debt totaling $4.8 million. My surgery center opened in 2024 and passed all CMS and state certifications with flying colors. Since that time we have personally covered all of the ongoing costs of the surgery center. We hired consultants to facilitate contracts with all insurers and were in the process of navigating that throughout the fall and winter of 2024. Around the time the post went viral, UNH stopped communication with my consultants, and have not allowed my surgery center to be in network. It is difficult for me to believe that this isn’t retaliation. It’s certainly not in the best interest of their members. By refusing to allow my center to be in network, UNH pressures me to either perform breast reconstruction surgeries in hospital facilities at a significantly higher cost, or to require their members to pay out of network facility penalties, or to ask insured patients affected by breast cancer to pay cash for their care. Their ongoing refusal to allow my surgery center to be in network is punishment for being a whistleblower. UNH is the dominant healthcare company in the United States. By refusing to allow my surgery center to be in network, they damage my ability to run a profitable practice and pay back the money I borrowed and earn back what I have invested. I have started a gofundme as a last resort to pay down some of my debt and avoid insolvency. I am committed to the health of my patients and the practice, and I’m facing a new challenge. I have built a center where patients affected by breast cancer can receive the highest quality of personalized care in an outpatient setting. I have opportunities to evolve and grow, and I am confident that I can navigate what lies ahead with time. I’m also certain that I have more work to do in creating change in the system as a whole. I am not afraid of the work ahead, but I need help. I ask for your consideration in contributing both to the health of this practice and that of the broader healthcare community. Hopefully you click through the link but in case you don't this needs to be read.

Billionaire investor Buffett owned about 1.18 million shares in UnitedHealth between 2006 and 2009, before selling his entire stake in 2010 amid a broader retreat from health insurers. The investment comes as UnitedHealth faces soaring medical costs, federal investigations, the fallout of the killing of a top executive and a cyberattack last year. The healthcare conglomerate has signaled prolonged pain with a new, far lower profit forecast as it sees billions of additional costs in the upcoming quarters. Shares of the Dow component have slumped 46% so far this year.

September 26Sep 26 Mangione’s presiding judge has ordered prosecutors to respond to a letter from Luigi Mangione’s legal team alleging that Trump administration officials’ recent social media posts about the case appear to have violated his right to a fair trial. https://truthout.org/articles/doj-appears-to-have-violated-luigi-mangiones-right-to-a-fair-trial-judge-says/ “It appears … that multiple employees at the Department of Justice may have violated Local Criminal Rule 23.1, and this Court’s order of April 25, 2025 specifically identifying the strictures of this rule,” U.S. District Judge Margaret M. Garnett wrote in her order on September 24 in response to the letter. The rule stipulates that “non-lawyer personnel employed by a lawyer’s office or subject to a lawyer’s supervision” in a criminal case have a duty not to release an “opinion that a reasonable person would expect to be disseminated by means of public communication” if there is a chance that the opinion will “interfere with a fair trial or otherwise prejudice the due administration of justice.” This includes any opinion as to the guilt or innocence of the accused, Garnett pointed out. “The statements referenced in the [letter from Mangione’s legal team] by two high-ranking staff members of the Department of Justice, including within the Office of the Attorney General, appear to be in direct violation of this Rule and the Court’s April 25 Order,” the judge continued.
