That's a distinction without a relevant difference.   Sure, the context is different.   But what meaningful difference is there between this process and a job applicant going before a hiring panel?   He's up for a job, and a group of people will decide in their complete discretion whether to give it to him or not.  He's gone before them to answer their questions to their satisfaction to inform that decision.    It's clearly a job interview.

Does the Senate have the ability to ask the FBI to do this, or do they need to convince Trump?   Then again if McConnell tells Trump he doesn't have the 50 votes today, does Trump have a choice.

It does if he doesn't vote to move it forward. Others may follow. There are procedural votes that have to take place before a floor vote.

Flake is saying he will only vote yes to move to floor right now. If there's not a FBI investigation he's going to vote no.
