I just read this page’s posts and see that, after another week on this most critical topic, we still haven’t reached a resolution, but I have every confidence in the brain trust coming to a verdict before the trial.

Keep fighting the good fight!

The right to stand your ground and the right to carry a knife with a blade of up to 5.5 inches. These are clear rules and beyond debate.

Who started the fight? This is not known yet.

How long was the blade? This is not known yet to the public.

Release the video.

Evergreen post.

Except it isn't "some random loser dumbass", it's representative of a large segment of the population that thinks this little shithead murderer was

  • framed
  • defending himself
  • upper management and statue material

Uh huh.

Though I'm quite sure that that's what your internet circles are telling you.

A whole shitload of us already have, thank you very much.

Just leave us the fuck alone. Leave a key under the doormat, leave some snacks in the pantry and a microwave dinner or three in the freezer, or even better, $20 on the counter for us to order pizza, and don't fucking wonder why, when you get home Sunday afternoon from whatever "convention" you and mom are attending, the TV is tuned to a scrambled Cinemax or Showtime channel, and why there's a half-empty tissue box and mom's expensive moisturizing lotion next to the TV.

No, it is the account of a either a crazy person, a bot, or a someone just trying to get views. Go look at his other posts. Getting yourself worked up because this person posts inane rants is stupid. Stop with the "rage" and try thinking for half a second.

A large portion of Gen X these days are basically boomers, they'll find their ragebait elsewhere if necessary.

I stopped blaming gullibility, lack of critical thinking, and internet naivete long ago (though all those factors certainly contribute). These people want to be lied to and emotionally manipulated. They seek it out. The more blatantly obvious the bot or bad actor the better.

I go with Occam's razor here and just say most people are just really stupid and being "controversial" mofos is the zeitgeist of our time.

I don’t even think they have the self awareness to want or seek it out. Their algorithms find the stupid to match their mindset and they jump down the rabbit hole.

Play adult games, win adult prizes.

Correct. There isn’t a choice whether to try someone who was 17 on the commission of an offense as a juvenile or an adult.  17 is an adult for the purposes of Texas criminal law.

From someone who saw the incident:

However, the footage reviewed by the Daily Mail at the Frisco Independent School District’s headquarters shows no obvious physical confrontation between the two prior to the stabbing.

The Daily Mail did not detect anything that indicated chaos was about to ensue.

Captured by a high-angle camera positioned near the press box and typically used for football broadcasts, the footage shows the tent at the top left of the screen.

Students are seen sitting idly beneath it, waiting for the competition to start.

Then, seemingly out of nowhere, it becomes apparent that the moment has happened when an armed Anthony attacked Metcalf

Don't make me tap the "Unreliable Source" sign. Not a commentary on the actual situation, but Daily Mail is a joke.

Does first-degree murder in Texas require planning or no? #notalawyer

I always heard that it had to pass the premeditated test? I guess bringing a knife to a track meet maybe shows premeditation. But just bringing the knife doesn't mean he planned to kill that particular victim, or does that matter?

Yeah, he might get convicted for stabbing that other guy!

That's the word I was looking for. I am not sure if the Surly lawyers have answered this already in this thread but I am curious.

- My father always said a jury trial is not just about the law. It's about assigning blame.

....

- This is about a sales pitch. It's not gonna be won the the law, it's gonna be won by the lawyers.

Goddamnit, you will not besmirch the good name of the preeminent online journal of high school teacher/student sex scandals.

I would think that since they went with first degree murder that it would indicate they feel fairly confident this was not self defense of any kind…but I’m not a lawyer so I could be completely wrong.

In Texas, capital murder is the most  serious charge and murder is what would be “second-degree” in many states but is a first-degree felony. The DA is not wordsmithing good.

LOL at chainsaw announcing that of course this won’t be fair.

What would you consider a fair trial and why will Karmelo not get one in your opinion?

You already know the answer to this. Why bother asking.

Not really. If they are going to charge, this is how you charge it. Manslaughter and criminally negligent homicide don't fit the facts.  "First Degree Murder" isn't really a thing in Texas. You have Murder, which is a first degree felony. But at the punishment phase it can be reduced to a second degree felony if the defendant can prove the murder caused by "sudden passion arising from an adequate cause" (basically, was provoked in a way that prevented rational thought).

Two things I’ve learned in my years on this site; the law is whatever our corrupt justice system says it is on that particular day and the surly legal cabal will find a way to justify it.

Most of our on site lawyers are completely wrong but does stop them from chiming in.
