That's what I was driving at earlier.  Had there not been the relationship between the parties, would have been an interesting question whether the Verve's sample would have infringed the original work.

And one thing to always bear in mind in music copyright cases:  the owner of the rights is often not the artist/authors, its a manager or record company, so not legally the same entity and often quite or completely "factually" independent (meaning doesn't need and doesn't have the blessing of the artists).

The usual division is that the artists often own the "composition" copyrights (words and music), while a manager or record company owns the rights to the performance/sound recording.  But that can vary quite a lot.

I don't doubt anything you say as being how copyright law works.  I just think copyright law seems broken in this case.  The song was an amalgamation of creative efforts and no one party is responsible for 100% of what the song evokes in a listener.  So the logical (if not legal) outcome would have been for neither party to receive 100% of the proceeds from the song.

Evidence would suggest Jagger/Richards aren't greedy bastards when it comes to songwriting credits.  Keef's daughter famously noticed the Stones' "Anybody Seen My Baby" was a cop of kd lang's "Constant Craving", however inadvertent, and so they added kd lang and Ben Mink as songwriters.

I love that song.  (Primitive Radio Gods, not the BB King source, which I don't actually know.)

Always loved checking what was sampled.   Its led me to some amazing music.   For instance, Stakes is High by De La Soul is one of my favorite songs

Checking the sample led me to this one by Ahmad Jamal and it became one of my favorite songs ever.   Absolutely amazing cut, Swahililand.   For the impatient ones, sample is at 8:07 but seriously listen to the whole thing.
