Another second amendment patriot successfully defends himself from....a brown person who knocked on the wrong door

I don't know where this goes.  We've had stories like this before -- guy shot a kid on his porch in KC, guy murdered someone who turned around in his driveway in Hays county (I think that's where it was), etc.

Well, now, a super brave second amendment patriot successfully executed a....chubby hispanic housekeeper who knocked on his door at the wrong address.  https://www.kvue.com/article/news/nation-world/family-demands-justice-for-cleaning-crew-worker-fatally-shot-after-arriving-at-wrong-home/507-cebaf9ca-3de5-4cac-a83e-938e970a49d6?tbref=hp

Police believe the couple worked as a cleaning crew and had gone to the wrong address by mistake. That’s when someone fired a single shot through the front door, killing the mother of four.

“The statute is pretty clear, you have a right to use deadly force to terminate unlawful entry into your dwelling,” said Villanueva.

“The castle doctrine basically means you have a right to protect yourself within your residence,” said Attorney Mario Massillamany.

Still, that use of deadly force does have to be reasonable and shooting through a closed door leaves that up for debate. It’s also not clear what the shooter knew or didn’t know before they pulled the trigger.

“There’s no real clear-cut winner on this. It’s almost like a law school exam question. It’s designed to have ambiguity,” said Villanueva.

As for a timeline, the prosecutor said no decision will be made until next week at the earliest. It’s also possible the case could be sent to a grand jury to decide.

Between our culture's absolute fetishization and worship of guns, to the point where you're a commie pussy if you DON'T use one, to most of our media feeding constant scary shit to whites and olds especially ("they're coming for you!  Venezuelan gangs!  MS-13!  THEY'RE RIGHT OUTSIDE, RIGHT NOW!), to the open demonization of all browns....shit like this happening, and continuing to happen, is inevitable.

So, thank God this homeowner protected himself from this dirty brown terrorist gang member intent on raping him with fentanyl!

Maria-Florinda-Rios-Perez-De-Velasquez-2

Gosh, I'm amazed he could pull off the task of.....shooting her through his closed door.....being how hard he had to have been shaking from such a fearsome attacker.

I dunno. Sort of seems more like straight up murder to me.

Is knocking on a door really unlawful entry? I was not aware there were laws against knocking on doors. So if you knock on a door you are exposing yourself to being legally killed?

I am somewhat doubtful that is true even in Texas.

It should.  But "stand your ground" laws are pretty fucking aggressive the other way.

I mean, they should be re-titled "gutless fucking coward who wants to shoot first and think later" laws, but the fact remains the bar is just barely higher than "I decided I was scared, and that's enough -- I have a perfect defense."

Yeah. I don't see any legal basis for killing somebody for knocking on your door. I cannot imagine that would generate much interest in law school. If that is ambigous then society as we know it is dead.

Surely a crime needs to be in the act of being committed before you can "stand your ground"? You can't just have feelings and therefore kill somebody.

The 350 million guns in the hands of Americans aren’t gonna shoot themselves. If some die inconveniently, well…

You'd think that.  And there have been convictions of folks who shot someone just for turning onto their driveway or knocking at their door.  But these stupid fucking "stand your ground" laws have just emboldened WAY too many people, and set up a fucked up value system: everything and everyone is an immediate threat, and shoot shoot shoot shoot, that's the only rational response to every "threat."

Set up a fucked up calculus, get fucked up results.

Notice how the article doesn't even mention who murdered her.

Have to protect him.  Note that this is in fucking Indiana, one of the most racist states in the union.  All presumptions must go in favor of the homeowner, who was surely just defending himself against someone who was likely a dirty illegal gang member rapist drug dealer boat captain terrorist.

I guess that’s one way to get rid of door to door salesmen, especially you window sales fuckers

If these laws were enacted with a limitation to applying them to sales types....I'm listening.....

‘Whitestown, IN’

Name of town alone suggests not guilty.

Literally in "Whitestown."  Looks like a suburb of Indiana, that is going from cornfields to cookie-cutter housing development.

The ABC story has a little more detail, including that it was shortly before 7 AM.

is that why there are no black people A Christmas Story?

im sure our resident murder dildo fetishist thinks this is a real shame...

But it could have been antifa or MS-13...knocking on your door...in the morning...in suburban Indiana.

Who are we to judge the homeowner's fear?

"One less Mexican to deport."

When most break ins occur, due to occupants most likely being both awake and home.

You're going to have to be more specific.

Brisket, all due respect, but you seem to just gloss over the fact that she was well-aware she was brown at the exact time when she knocked on the door.  Seems like there is a willfulness element in there.

Does this mean I can start shooting these fucking water treatment solicitors when they bang on my door while I'm 'batin?

Yeah.  That's when you gotta really be ready for a home invasion -- the time when people start their day.  That's, like "home invasion planning 101."

Also, this is perfection:

Quote

"We are working closely with the Boone County Prosecutor's Office to ensure every aspect of this case is handled with care and diligence," police said, noting that an update will be provided next week "due to the complexity of the investigation."

"The complexity of the investigation."  That's cop-speak for "we gotta find a way to blame this on the brown person."

If this fuck gets off unscathed, you can then legally shoot Door Dash, FedEx, UPS, DHL (laugh), Amazon, your neighbor's kids selling popcorn, your OWN maid service, and of course door to door sales people with no fear of consequence.

And holy fuck, you better watch your kids on Halloween.

I'm putting my faith in fucking Indiana to do what's right here and lock this dickhead up. I like Halloween too much. (ya ya ya, "I hate to break it to you" replies incoming... I get it)

From 2007, and still relevant.

Legally, I believe that's called "assumption of risk."

That would probably explain the slow play on the charges or even releasing his name.

& If she did NOT know, would that qualify as "willful negligence"?

I mean... anything to ensure Whitey McInnocent has a plausible deniability to use.

He could see she had with her a chemical weapon (bleach) and had to make a quick decision.

There was just a Netflix documentary about a very similar situation. The Perfect Neighbor.

Don't leave out cops that show up for a little "Knock and talk".

Not really similar, because the victim and murderer lived in the same neighborhood and had been antagonistic toward each other, and at the time of the murder I recall the victim went to the murderer’s house to confront her about behaviors toward the victim’s kids.

This was the murder of a complete minority stranger who just knocked on a door.

But still, two murders by two racists emboldened by laws enacted to cloak their racism.

Correct. And she went to prison. So this should be a slam fucking dunk. But we live in the dumbest timeline, so I’d put it at 50-50 at best.

Update: no charges yet. Prosecutor says they're going through "a mountain of evidence."

Yeah....a mountain that looks a lot like "he's an old white cop.  Gotta find a way to smear the victim and blame her so it's a justified shooting" or some shit like that.

Wife was watching courttv or some similar nonsense, but they had some detailed coverage of this.

Apparently, they had keys to the house and were rattling around before sunrise.

Not a good reason to shoot someone, at all.  But does go a little ways to explaining some pearl clutching by the homeowner.

If someone rolls up to my house trying to unlock the door at 6am, I'll probably draw...

Which means this dude is probably going to skate.

Edit: of course that is the story, whether it happened or not.

I’ll never understand a world where it’s ok to just shoot someone through the door. What a fucking coward. I could understand if they’ve busted in, but if you’re afraid of someone outside your home you should call 911.

I literally had someone open my front door, which was unlocked, around 8pm one night. My dogs went nuts and she quickly realized she was at the wrong house and shut the door and moved on. It would never occur to me to pull a gun. Good god people.

Shot and killed through a still locked and intact door is the similarity.

Man, I almost get it. Someone rattling around your door when it's still dark outside or close to it, maybe they have a lockpick or master key, who knows. I get being ready for the absolute worst case scenario. But what the fuck happened to "Who's there?"

Same, but after midnight. The wife of a neighborhood couple having a fight.

We took her in, and I threw him out. No gun required.
