Tucker was definitely losing his cool, but unless they've changed things legally, the 19th century laws are still on the books in Montana and once Tucker touched him, I think that guy legally had the right to mount Tucker and show his dominance over Tucker.  I think it would have been allowed since this was on private property and they did not appear to be in the view of any unmarried women or children under the age of 11, and it was not on a Sunday (or least before 2pm on Sunday, my memory is hazy).

 If Tucker's wife had been around, I think at his behest, she would have had to take his place in the mounting ritual, and allowed herself to be mounted for a minimum of 4 minutes, 20 seconds, not to exceed 10 minutes, 30 seconds (although there are reports of wives taking their husband's place in the mounting and subsequently allowing themselves to be mounted for hours on end, much to the consternation of their husbands).

If, however, she was able to produce a $20 gold piece or two cords of firewood within an agreed-upon time, with the cord size based on the 1879 Montana Standard Cord Unit (MSCU) of 180 cubic feet and not the 1873 MSCU of 176 cubic feet (the 1879 MSCU was adopted as the official cord measurement when Montana became a state in 1889), then Tucker would have had to allow himself to be mounted. That may sound odd and a bit barbaric/primitive, that a wife could be compelled to take a husband's place, but the courts ruled in 1891 that there should be a way out for the wife if she produces the Double Eagle or the 2 MSCU's, since it's not technically her fault he wronged another person.  There's even some debate among legal scholars in Montana these days as to whether she can be compelled to substitute for her husband in the mounting ritual or produce the Double Eagle (which in 2021 is worth over $1,000) or two cords of wood, since Montana voters struck down the law in 2014 that stated wives are the property of their husbands.

If he was flying solo and his wife was not around, or she was around and could produce the Double Eagle or firewood, he would have to voluntarily subject himself to being mounted for a minimum of 9 minutes 30 seconds, and not to exceed 13 minutes, 15 seconds. Regardless of who gets mounted, a record of the mounting must be filed within 24 hours at the county courthouse.

The fishing guide seemed pretty nice though, and/or did not want to be filmed mounting Tucker.
