What in the ever living fuck makes you think that a constitutional amendment could pass and be ratified in this political environment?

For some reason their animosity for the EPA stands out in my mind.

Because it regulates the greatest number of their most wealthy donors.

Buddy once the cancer fascism gets it's hooks in, it takes fucking chemotherapy to fix it. Barring a major political and systemic upheaval, it's going to be decades to unfuck things.

The process can't even start until the Supreme Court gets unfucked.  That will take decades by itself.

I'm so fucking despondent after the events of this week. And the hits are just gonna keep on coming. Like, I can't even muster up the energy to be mad about this shit, which is, of course, exactly what they want.

There will be plenty of furrowed brows.

Did Consumer Protections also take another hit?  If I were an old, I might start wondering about my Social Security.

Did you read further upthread? I'm saying this is all happening because the legislature isn't legislating. The response is "the legislature can't legislate because it can't legislate" and I responded with a way they could actually legislate it into existence to which the further replies were "LOL BUT THE LEGISLATURE CANT LEGISLATE"

Our problem is Congress. It's forced Executive and Judicial Branches to start legislating from the EO and the Bench. This is our fault for not holding our fucking elected legislative officials accountable and letting them just suck on the teet of american taxpayer dollars for lifetimes with little to no body of work.

Congress is extremely dysfunctional but it's not THE problem here. THE problem is conservative justices lying about what the Constitution says. The nondelegation doctrine they've made up has no basis in text or history and is a fake legal doctrine they invented specifically because it would be impossible to actually comply with even if Congress functioned well.  Even if Congress was functioning well, with this Court they'd simply ignore any amendment that was actually passed and ratified to try to address their bullshit.

I'm just telling you--if you think what the Court has done thus far is a disaster, wait until tomorrow's decision in the EPA case.

No lawyer, but SCOTUS dismantling Congress’ power to enact laws, like the one delegating authority to the EPA, is on the track to establishing monarchical rule.

The power of the purse is next.

this court is literally rewriting statutes congress passed and were signed into law by the executive because it doesn't like the statute, so created out of thin air rules to either gut or invalidate the statute.  congress could be well-functioning and that wouldn't stop this court at all.

no I'm not - I'm right and you guys are all just being stupid about it. The entire reason the Supreme Court got stacked with judges is because the legislature isn't legislating and the reason that they are overturning things that are constiutional is because they are in fact not at all legislated or put in the constitution, by you guessed it LEGISLATORS.

It's absurd to say that the Supreme Court broke all on its own and of it's own accord. It was a vehicle used to rule, just like the executive office was used when GWB was in office.

the GQP is certainly to blame for the rampant abuse of the government and it's ultimate unraveling of functionality - but that ONLY HAPPENED BECAUSE LEGISLATURE STOPPED LEGISLATING

The GOP and the right are getting literally everything they've wanted for the last 40 years via a radical Supreme Court. They are legislating from the bench and changing the very fabric of this country. What they are doing is extremely dangerous.

dude the VRA was legislated and passed into law by a well functioning congress.  and congress clearly has the authority under section two of the 15h amendment to do the VRA.  this supreme court gutted it anyway.

Nevermind - fuck it the reason the supreme court is fucked is because the supreme court is fucked. There is no other reason. It didn't happen because of something else, it's actually just a magic problem that appeared out of nowhere and thin air.

The Supreme Court is fucked because the Republican party understood they could transform it into a star chamber and the Democrats would let them.

yeah dude - it's not fucking hard. Congress fucked up and hasn't done shit forever. Because Congress is deadlocked people started finding ways around congress. First it was unitary executive theory. Then that got fucked, so then it became stack the court to legislate from the bench, which is what we are seeing now. It's not fucking hard to understand. The core issue is that Congress isn't doing shit.

The GOP stacked the Supreme Court specifically to invalidate any legislation that Democrats managed to get through Congress.

It is a radical court dominated by radical Republicans. Democrats should start referring to it as such and never let up.

Why does it have to be one or the other?  Congress is fucked up.   It's filled with a bunch of wackos or checked out long termers  in safe seats due to gerrymandering.  I don't think anyone here disagrees with that.  The Supreme Court is also fucked up and is rendering batshit decisions sounding in Calvin Ball.

These poorly thought out, angry drop in hot takes crack me the fuck up.

The fact of the matter is that the Supreme Court is packed because the Democrats badly misplayed their hand.

RBG should have retired during Obama's 1st term, and they should have put up a fight for Merrick Garland instead of assuming Hillary would win.

the democrats could decide to nuke the filibuster and pass a new VRA tomorrow and this supreme court would still nuke it.  that's what imma isn't getting.

for fuck's sake they finally got around to passing a bare modicum of gun control legislation and the supreme court pre-gutted it.

Both of these are true.

Toss on top the skewed representation in the Senate, and we've got ourselves a stew of democratic disaster!

don't forget about states rights being shit on in NY too. It's 3 decisions that are in direct conflict with eachother.

1 STATES CANT RESTRICT RIGHTS

2 FED GOVERNMENT CANT DICTATE STATES RIGHTS

3 STATES CAN DO WHATEVER THEY WANT AS LONG AS THE PEOPLE ARE BROWN

If they nuke the filibuster, they could expand the court. That way the court will always rule for the party in power. It's a whole lot worse than what we used to have, but also a whole lot better than the current court ruling in favor of the party that was just voted out every time.

Which is why Democrats should introduce a bill that limits judicial review for cases that do not involve original jurisdiction as set forth in the Constitution.

What makes you think the conservative justices wouldn't just say "no you can't do that"?

Dems just need to stop bringing piss to a shit fight. They could start playing dirty. Secret service can start digging into the dirty laundry behind Kavanaugh's gambling debts. And I am sure there is some dirty laundry with Barrett, too. Make them think twice about activism. Is there any question whether DeSantis or Trump would do those things to liberal justices if the supreme court were stacked the other way and it was getting in their way?

If they want a constitutional crisis, if they want a culture war, then the Dems should start fucking fighting.
