That may technically be true, but he was an interim head coach for multiple years at USC: Prior to his appointment as head coach at Texas in April of 2001, Elliott posted two remarkable seasons as the interim head coach at the University of Southern California. He compiled a record of 50-12 while leading the Women of Troy to their first NCAA Semifinals appearance in 15 years and first-ever share of the Pac-10 Conference title. In 2000, USC finished the season ranked No. 4 nationally by both the AVCA and Volleyball Magazine while going 29-3 en route to the NCAA Semifinals. Elliott was honored as Pac-10 Coach of the Year both seasons, as well as being named the 2000 Pacific Region Coach of the Year. Under the leadership of Elliott, the Trojans featured two All-Americans in 2000 (April Ross and Jennifer Pahl) and six all-conference players, including the Pac-10 and Region Freshman of the Year (Ross). In both 2000 and 2001, Elliott’s recruiting class was regarded as No. 1 in the nation, the school’s first-ever No. 1 recruiting classes.

And he's going to argue that he was totally innocent. Unless we are going to say that being falsely arrested is grounds for termination, then there is an argument about what actually happened. That is my point here. I think firing him was the right decision, although I do not understand why they waited so long if they were not really doing any additional investigation. But I am just not as willing as most to think that Beard does not have a legal avenue to complain if he so chooses.

You're experience with cops must be very different that my, admitted second hand experience. My wife used to do civil cases involving the cops and their MO generally seemed to be arrest first, worry about everything else later.

According to her own statement, she literally accosted him and broke his glasses while he was sitting down and reading, but calling the cops is one step too far? My guess is that something physical happened, but it seems like a line-drawing exercise to try to determine exactly what she was capable of doing because she was mad at him for not paying her enough attention.

*alleged fight. The whole point is we do not know what happened that led to his arrest. It seems likely there was a two-way fight, but we do not know that at this point.

That whole discussion was bout claiming sovereign immunity. A&M could get out of the contract by firing him for cause and then not have to prove the cause because of sovereign immunity. Like I said, I don't think they would do that, but they can because Texas has crazy strong sovereign immunity laws.

That's not legally correct. The employer has the burden of proving the cause when firing an employee for cause.

Even if they legally can, I doubt they would. A&M got Jimbo because they were willing to offer more guaranteed years. If coaches know those guarantees are not worth anything, it will be difficult to get the same level of coach. It doesn't matter as much for Tech, because Tech is generally not looking to hire that quality of coach, so the guarantee matters less.

If UT is going to stay out of court, they are going to have to prove they win even assuming the facts are as Beard alleges. So assuming that he alleges that he is totally innocent and never did anything physical, then what is the conduct unbecoming? Being falsely accused of a crime and then being falsely imprisoned for that crime? Obviously that is probably not what happened, but if UT is going to avoid a trial altogether, it's difficult to do on a loose standard like "conduct unbecoming."

If they are basing his termination on the "unbecoming" portion and not the charged with a felony portion, it is definitely going to court, which is my point. I think Beard has enough to at least get a trial, including discovery, which I imagine both sides would prefer to avoid.

I've already expressed my opinion that he arguably did not if he did not do the "conduct" that led to the charge, but obviously most people disagree. My guess is it is enough to get into court, but it will depend on the judge.
