I think, as stupid as it is, this is more nuanced than that. They are using the cover of "we don't want our soldiers thinking for themselves" to attack the idea that blanketly telling any soldier they have an obligation to not follow illegal orders assumes the soldier knows the law(s). In truth, the statement from Kelly and others was not directed at the common soldier, it was directed at those way nearer the top who should "know better" and are the ones carrying potentially illegal orders out. It's really not the grunt piloting the drone or dropping the bomb this statement was aimed at, it's the person up the chain of command who has the actual decision-making ability to decide if something is lawful or not. the regime doesn't like the insinuation in the first place and is trying to quash it on that level, but they really don't want that assertion rattling around in too many officers' heads. they want blind obedience when they haven't even earned basic trust, as demonstrated by the dead seafarers smuggling checks notes weed.
