No. This case was literally a court enforcing Title IX, so deriving from it that Title IX is somehow unenforceable is a fairly bizarre conclusion. Title IX prohibits discrimination on the basis of sex in educational programs funded by the federal government. The court ruled that transgender discrimination is discrimination on the basis of sex. Title IX regulations do allow for separate bathrooms/locker rooms on the basis of sex. In this case, the student, who was born female, had received an amended birth certificate designating him as male. But the school district policy assigned students to bathrooms based upon their genitalia, not birth certificates. The court ruled that such a policy constituted transgender discrimination under Title IX. The court did not reach whether assigning bathrooms based upon birth certificate would violate Title IX.

Surely you’re not arguing that as long as as I previously told someone you cheated on your wife, it wouldn’t be extortion for me to threaten to tell other people unless you pay me.

Extortion is basically obtaining money by threat of violence, financial harm, adverse governmental action, or harm to reputation. You have a right to publicize that I was arrested. But it’s extortion to say “I’m going to publicize that you were arrested unless you give me $1000.”
