Well, Colbert doesn't masquerade as news, but has a newsy component. Whereas Fox is the opposite and CNN less so. That's the main distinction, which places Colbert further out of the "equal time news exception" intention or ambit. So, if you're going to make it that broad, then you have trouble. And if you're going to grant or deny "favorable treatment" on the basis of misinformation, quit fucking around and ban misinformation. That, unfortunately, probably has 1st Amendment problems.

I should add that I like Colbert a lot and don't think he's toxic. But it's really hard to differentiate his infotainment from Fox infotainment on a principled basis other than misinformation.

I'm not sure I buy this. A lot of transactional work, from assembly of deal docs to due diligence sure looks rote and like something AI could do, with careful review by probably more senior attorneys. But the devil is in the details, and sometimes the littlest thing can make all the difference, and it would only be caught by a sharp-eyed associate doing the rote stuff (and billing the shit out of it). Now, clients might demand the use of AI in lieu of massive associate bills for that work and assume the risk, accordingly. But, I think most big-time corporate/transactional stuff bills as a percentage of the deal, so it may not be the clients' call in a lot of cases.

Yeah, for many years, the big Houston and Dallas firms pretty routinely took solidly ranked SMU, Baylor, and UH grads, even South Texas. For one thing, a good bit of the partnerships of those firms were graduates of those schools. But as national biglaw takes over regional and even national, but Texas HQ firms, firm resume obsession increases and it's probably harder to get by there without UT as a minimum. When I was in school, I was always pissed when some lesser school kid got a clerkship offer and I didn't, because UT Law. In the actual practice of law, it doesn't matter much.

I dunno what to think. I initially thought the notion that standardized tests were culturally or otherwise biased was ridiculous. My views on that have changed somewhat. I don't want to think or state that they are the end-all, be-all of, well, scholastic aptitude. But I have to say that most of those with high SAT scores were some of the smartest people I knew. Can't say that with near as much frequency for high class rank. Also, achievement tests were used to place people in the right math and english, among other things. What do they do now? I do think there's probably a wide gulf between top X% at an economically advantaged high school versus disadvantaged, and auto admit might be a disservice to the latter. At the old easy-in, easy-out fail-out UT, I think that would have been very true.
